Terms and Conditions: WebBoss Digital

1. Website Packages

  • Contract Term: All packages are subject to a minimum 12-month contract. Longer-term contracts are also available. Agreements automatically renew annually unless terminated in accordance with Section 5.

  • Rapid Turnaround: WebBoss maintains one of the fastest turnover times for bespoke website providers.

  • Sign-Up Process: You will receive a confirmation email upon signing up. One of our agents will then call you within 24 business hours to proceed.

  • Custom Conditions: Any client-specific contract conditions can be discussed and added to your agreement upon sign up.

  • Payment Structure: The setup fee is paid first to commence work. Your service level agreement and recurring payments begin once the website is completed and live.

  • Refund Policy: WebBoss Digital operates a strict no-refunds policy. All payments are final, non-refundable, and non-transferrable.

  • All-in-One Service: WebBoss.ie provides a comprehensive package including: Domains, Hosting, Website Design, Search Engine Results (SER), Search Engine Optimisation (SEO), and Search Engine Marketing (SEM).

2. Scope of Services

2.1 Maintenance & Security

  • Front-End Maintenance: Website content updates (text, images, new pages), design/layout modifications, addition of widgets/features, and SEO tuning.

  • Restoration: Data/design recovery from Client errors and restoration after plugin-related issues (for plugins not added by WebBoss).

  • Back-End Security: Server Firewall, IP/country blocking, daily vulnerability scans, password auditing, and real-time threat defense.

  • Access Control: To maintain the integrity of the server and the website database, cybersecurity is managed solely by WebBoss.

    • Third-Party Access: Granting access to any third-party developer, agent, or individual is strictly forbidden. The Client is prohibited from sharing login credentials or creating unauthorized accounts.

    • Breach of Protocol: Any attempt to bypass security restrictions or provide external access will be treated as a material breach of contract, resulting in immediate termination of services without notice or refund.

  • Tagging Requests: Analytics tag requests will be reviewed and responded to within 7 to 14 days.

2.2 Data Backups & Site Recovery

  • Backups: Weekly full-site and database backups stored in secure cloud storage.

  • Recovery: Free full-site recovery in the event of a breach or data loss. Ensuring data currency post-recovery is the Client's responsibility. If a breach is caused by Client negligence or unauthorized third-party interference, recovery will be billed at an emergency hourly rate.

2.3 Hosting & Domain Management

  • Managed Hosting: To ensure maximum performance, security, and stability, Top-Tier Managed Hosting is included in all client contracts.

  • Domain Ownership: WebBoss Digital provides a complimentary domain for the first year. All domains are registered and managed under WebBoss Digital for technical purposes.

  • Renewals & Transfers: Renewal fees are bundled into the annual service fee. Transferring a domain to an external registrar may result in website/email downtime. All outstanding service fees must be settled before a transfer is initiated.

3. Search Engine Optimization (SEO) Disclaimer

While WebBoss implements industry-standard strategies for first-page visibility, results are influenced by factors beyond our control. A key component of success is the quality/quantity of backlinks; without an effective profile, results may be limited.

  • Geographical Scope: Standard services target all of Ireland (County and Nationwide). Restricting or localizing a strategy after the initial agreement constitutes a significant change, requiring recalibration and an additional service charge.

4. Client Obligations

  • Financial Commitments: Timely payment of all setup and annual service fees.

  • Notice Period: Provide timely written notice (6 months) for contract termination.

  • Content Delivery: Provide accurate and timely content for the website and SEO efforts.

  • Analytics & Tracking: Implementation and maintenance of Google Analytics, heatmaps, or pixels are additional line items and incur standard implementation/maintenance charges.

  • Technical Integrity: The Client shall not implement external tagging or third-party scripts without written consent. Unauthorized implementation may result in immediate contract termination.

5. Termination & Decommissioning

  • Agreement Duration: Valid for a minimum of 12 months, renewing annually. Written notice must be provided at least six (6) months prior to the renewal date.

  • Termination for Cause: WebBoss reserves the right to terminate this Agreement immediately if the Client violates the "Third-Party Access" policy (Section 2.1).

  • Cessation of Coverage: Once cancellation notice is received, WebBoss will not cover subsequent third-party fees or charges.

  • Standard Cancellation Fee: A mandatory decommissioning fee of €350 (plus any outstanding contract balances) applies to all terminations. This covers administrative decommissioning, server cleanup, and data handover.

  • Finality: The website will be taken offline and files removed from the server on the domain renewal date unless a transfer is completed and all fees are paid.

  • Licensing: Proprietary software licenses or "Developer Edition" plugins owned by WebBoss will be deactivated upon termination.

6. Limitation of Liability

Our liability is strictly limited to the direct costs associated with the specific services provided.

  • Indirect Damages: WebBoss is not responsible for loss of earnings, data breaches, downtime, or issues arising from third-party integrations (payment gateways, CRM, etc.).

  • Third-Party Intervention: WebBoss shall be held harmless for any site failure or security breach resulting from the Client providing access to an external developer or agent. The Client assumes all risk for the actions of third parties.

7. Entire Agreement

Payment for services signifies full acceptance of all terms outlined herein. This Agreement overrides any previous arrangements. Any changes must be mutually agreed upon in writing.
